Free Scan Terms

These Free Scan Terms (the "Terms") are a legal agreement between datadir s.r.o., a company incorporated in the Slovak Republic (IČO 57582904) with its registered seat at Bauerova 1205/7, 040 23 Košice ("we", "us" or "our"), which operates the temnir service, and the individual or organization that requests a free scan ("you"). By requesting a free scan, submitting a domain, or confirming a scan request by email, you accept these Terms and confirm that you have authority to accept them. If you do not accept these Terms, do not request a free scan. The free scan is provided free of charge for general information.
1. Definitions
In these Terms: "Free Scan" means the passive, packetless security check we make available on this site; "Your Domain" means a domain name you submit for a Free Scan; "Results" means the findings and any report we generate from a Free Scan and send to you; "DNS" means the public Domain Name System; and "Privacy Notice" means our privacy notice published on this site. Headings are for convenience only and do not affect interpretation.
2. The Free Scan
When you request a Free Scan, we examine only information that Your Domain publishes publicly in the DNS. We check email authentication hygiene (your SPF, DKIM and DMARC records) and look for dangling or unclaimed DNS entries that could permit a subdomain takeover. We do not connect to, log in to, probe, send traffic to, or run any test against your servers, applications or other infrastructure, and we examine only the domain you submit and no other host. The Free Scan is passive and packetless, and we read publicly available records only.
3. Eligibility and authorization
By submitting a domain you represent and warrant that you own Your Domain or that its owner has authorized you to request a Free Scan of it, that you are entitled to receive the Results, and that your request complies with all laws that apply to you. You must not submit a domain that you do not own or are not authorized to request a scan for. We may ask you to evidence your authorization, and we may decline or discontinue a Free Scan at our discretion.
4. Acceptable use
You agree not to: resell, sublicense or commercially redistribute the Results; use the Free Scan to attack, disrupt, probe or harass any third party; use it to build or train a competing product or dataset; circumvent or exceed any rate limit or access control; or use the Free Scan in any unlawful manner or in breach of these Terms. We may suspend or withdraw access for any user whose use we reasonably consider abusive.
5. Results and no warranty
We provide the Free Scan and the Results "as is" and "as available", without warranties, conditions or representations of any kind, whether express, implied or statutory, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement. No security check identifies every issue. The absence of findings does not mean that Your Domain or your organization is secure, and the Results may contain false positives or false negatives. You are responsible for independently validating any finding before you rely on or act on it.
6. Not professional or compliance advice
The Results are provided for general information only. They are not professional, legal, security or compliance advice, and they do not audit, certify or confirm that you meet the requirements of the NIS2 Directive or any other law, standard or framework. You should obtain a professional assessment before relying on the Results for any compliance, security or business decision.
7. Intellectual property
We and our licensors retain all intellectual property rights in the Free Scan, the Results and this site. Subject to these Terms, we grant you a non-exclusive, non-transferable and revocable right to use the Results relating to Your Domain for your own internal security purposes. You obtain no other rights, and you must not remove or alter any notice contained in the Results.
8. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable mandatory law, and your rights as a consumer are not affected. Subject to that, and to the fullest extent permitted by law: we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, data, goodwill or anticipated savings, whether arising in contract, tort (including negligence) or otherwise; and our total aggregate liability arising out of or in connection with the Free Scan and the Results will not exceed one hundred euro (EUR 100). Because the Free Scan is provided free of charge, you acknowledge that this allocation of risk is reasonable.
9. Indemnity
You will indemnify us and hold us harmless against any loss, liability, cost or expense (including reasonable legal fees) arising out of any third-party claim that results from a Free Scan you requested without authorization, from your breach of these Terms, or from your unlawful or improper use of the Free Scan or the Results.
10. Data protection
We process the domain you submit, your email address, and your IP address and a timestamp as a record that you requested the Free Scan and gave any consent. We use these to carry out the Free Scan and to send you the Results. Any marketing beyond the Results is separate, optional and based on your consent, which you may withdraw at any time, and every marketing email contains an unsubscribe link. Our Privacy Notice explains what we collect, the legal basis for processing, how long we keep it, the processors we use, and your rights.
11. Availability, changes and suspension
The Free Scan is provided free of charge and without any commitment as to availability. We may change, suspend, limit or discontinue the Free Scan, in whole or in part, at any time and without liability to you. We may also update these Terms from time to time; the version shown at the top of this page identifies the current Terms, and the Terms that apply to a Free Scan are those in force when you request it.
12. Severability and waiver
If any provision of these Terms is held to be invalid or unenforceable, that provision will be applied to the maximum extent permitted or, if it cannot be, severed, and the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of it.
13. Entire agreement and assignment
These Terms, together with the Privacy Notice, are the entire agreement between you and us in relation to the Free Scan and supersede any prior understanding on that subject. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign ours to an affiliate or successor. These Terms do not create any rights for any third party.
14. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Free Scan, are governed by the laws of the Slovak Republic and are subject to the exclusive jurisdiction of the courts of the Slovak Republic, without prejudice to any mandatory protection available to you as a consumer in your country of residence.
